Terms of Service

SwiftGigs is a Canadian online marketplace that connects individuals who need local tasks completed ("Posters") with individuals who complete those tasks for pay ("Workers"). MoTechCo acts solely as a platform intermediary and is not a party to any agreement between Posters and Workers.

Eligibility. You must be at least 16 years old to create an account. Users under 18 (or under the age of majority in their province or territory — 19 in AB, BC, NB, NL, NS, YT, NT, and NU) may register only with the involvement of a parent or legal guardian, as described below.

Accounts for users aged 16–17. If you are 16 or 17, your account remains inactive ('pending guardian approval') and cannot apply for or accept paid tasks until your parent or legal guardian: (1) confirms their consent through the link we email them, and (2) completes payout setup with our payments provider (Stripe) as the account holder who receives funds on your behalf. Payout recipients must be adults, so all payments earned through your account are received into your guardian's connected Stripe account. Your guardian is responsible for the financial and contractual obligations associated with your account, including agreements you enter with task posters.

Both steps are required. Guardian consent alone does not activate paid activity; guardian payout setup alone does not either. Until both are complete, your applications cannot be accepted.

Users under 16. SwiftGigs is not available to anyone under 16, and we do not knowingly permit their registration.

To use SwiftGigs you must also:

• Be a resident of Canada
• Have a valid email address and phone number
• Agree to these Terms and our Privacy Policy

By registering, you confirm that the information you provide is accurate and complete.

You are responsible for maintaining the confidentiality of your account credentials. You agree not to share your login information with anyone. You must notify us immediately at mowebsiteco@gmail.com if you suspect unauthorized use of your account. MoTechCo is not liable for any loss resulting from unauthorized use of your account.

4.1 Posting Tasks
Posters create task listings describing the work needed, the location, budget, and task mode (Quick, Standard, or Recurring). The minimum task budget is $20 CAD.

4.2 Applying for Tasks
Workers browse available tasks and submit applications including their bid price and a message to the Poster. Submitting an application does not guarantee acceptance.

4.3 Accepting Applications
Posters review applications and select one Worker. Once a Worker is accepted, payment is required before any work begins and before the chat between Poster and Worker is unlocked.

4.4 Escrow and Payment
Upon acceptance, the Poster's payment is held in escrow via Stripe. Funds are released to the Worker only after the Poster confirms the task is complete. SwiftGigs retains a platform fee of 25% of the task value (20% for subscribers, 15% for top-rated Workers).

4.5 Task Completion
Once the Poster confirms completion, Stripe releases the Worker's payout. Both parties are then invited to leave a review.

All payments on SwiftGigs are processed in Canadian dollars (CAD) through Stripe. By using the platform you agree to Stripe's Terms of Service. MoTechCo absorbs standard Stripe processing fees so that the price you see is the price you pay. Platform fees are non-refundable once a task is completed.

You agree not to use SwiftGigs to:

• Exchange contact information before payment has been made through the platform
• Arrange payment or continuation of work outside the platform within 12 months of a connection made through SwiftGigs
• Post, request, or facilitate any adult or sexual content of any kind
• Harass, threaten, or discriminate against any other user
• Create fake accounts or impersonate any person or entity
• Post fraudulent, misleading, or illegal task listings
• Use the platform for any illegal activity under Canadian federal or Alberta provincial law
• Attempt to circumvent the platform's security or payment systems

Violation of these rules may result in immediate account suspension or permanent ban without refund.

Workers on SwiftGigs are independent contractors, not employees of MoTechCo. SwiftGigs does not control how Workers complete tasks, set their schedules, or determine their methods. Workers are solely responsible for their own taxes, insurance, and compliance with applicable laws including Workers' Compensation Board (WCB) requirements in Alberta.

If a dispute arises between a Poster and a Worker, either party may contact SwiftGigs at mowebsiteco@gmail.com to request mediation. MoTechCo reserves the right to make a final decision on dispute resolution at its sole discretion, including releasing or withholding escrow funds. MoTechCo is not liable for the quality, safety, legality, or outcome of any task completed through the platform.

SwiftGigs is a platform intermediary only. To the maximum extent permitted by Alberta and Canadian law, MoTechCo is not liable for any injury, loss, or damage arising from tasks completed through the platform, the conduct of any Poster or Worker, loss of earnings or data, or any technical failures or outages. You use SwiftGigs at your own risk.

All content, design, code, branding, and materials on SwiftGigs are the property of MoTechCo. You may not copy, reproduce, or distribute any part of the platform without our written permission. The SwiftGigs name and logo are proprietary to MoTechCo.

Your use of SwiftGigs is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

MoTechCo reserves the right to suspend or terminate any account at any time for violation of these Terms, fraudulent activity, or any conduct we determine to be harmful to the platform or its users. You may delete your account at any time by contacting us at mowebsiteco@gmail.com.

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada. Any disputes shall be resolved in the courts of Alberta.
